Native American communities have distinct legal rights rooted in tribal sovereignty, federal Indian law, and treaty obligations. Idaho Legal Aid Services (ILAS) recognizes these unique circumstances and provides culturally informed representation to tribal members across the state. We handle Indian Child Welfare Act (ICWA) cases that keep Native children connected to their families and heritage, assist with tribal enrollment disputes, navigate jurisdictional questions between tribal, state, and federal courts, and protect access to treaty rights and services. These services are part of two specialized teams that expand our reach statewide.
In 2024, our Indian Law Unit closed 86 cases involving wills and estates, consumer protection, family matters like guardianships and custody, and Social Security Disability Insurance claims. ILAS also partners with tribal governments and Native organizations to address systemic barriers.
